IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Dispute Resolution

11.1 Informal Resolution

We prefer to resolve disputes informally. Before filing any legal claim, you agree to try to resolve the dispute by contacting us at legal@seihub.xyz. We will try to resolve the dispute informally by contacting you via email.

11.2 Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the arbitration rules of the applicable jurisdiction, except where prohibited by law.

11.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in any class action or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SEIHUB App is registered, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on our Services and updating the "Effective Date." Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
